Terms of Service for KINETIC FLOW AI

Agreement to Terms

By accessing or using KINETIC FLOW AI ("the App," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

KINETIC FLOW AI is a fitness and nutrition tracking application that provides:

• Workout logging and tracking
• Nutrition and meal logging
• Progress tracking and analytics
• Gamified points system
• AI-powered fitness and nutrition recommendations (where available)
• Community features (where available)

User Accounts

Account Creation

• You must create an account to use certain features of the App
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate, current, and complete information during registration
• You must be at least 13 years old to create an account

Account Security

• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account
• We are not liable for any loss or damage arising from your failure to protect your account

Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Transmit any harmful code, viruses, or malicious software
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use the App to harass, abuse, or harm other users
• Impersonate any person or entity
• Collect or store personal data about other users without permission

Health and Fitness Disclaimer

• The App provides fitness and nutrition tracking tools for informational purposes only
• Always consult with a qualified healthcare provider before starting any exercise or nutrition program
• Do not use the App if you have any medical conditions that may be affected by exercise or dietary changes
• We are not responsible for any injuries or health issues that may result from using the App
• The App's recommendations are general guidelines and may not be appropriate for your specific needs

User Content

Content You Submit

• You retain ownership of any content you submit to the App (workout logs, nutrition data, etc.)
• By submitting content, you grant us a license to use, store, and process your content to provide the App's services
• You are solely responsible for the accuracy and legality of content you submit

Prohibited Content

You agree not to submit content that:

• Is illegal, harmful, or violates any laws
• Infringes on intellectual property rights
• Contains personal information of others without consent
• Is false, misleading, or deceptive

Points and Virtual Currency

• Points ("GP" or "V") earned in the App are virtual currency with no real-world value
• Points cannot be exchanged for cash, refunded, or transferred
• We reserve the right to modify, suspend, or terminate the points system at any time
• Points may be reset or adjusted for system maintenance or policy violations

Subscriptions and Payments

Subscription Tiers

• The App may offer subscription tiers (Basic, Pro, Elite) with different features
• Subscription terms, pricing, and features are subject to change
• Subscriptions may be managed through your Apple App Store account

Payment Terms

• All payments are processed through Apple's App Store
• Subscriptions automatically renew unless cancelled
• You may cancel your subscription at any time through your App Store account settings
• Refunds are subject to Apple's refund policy

Intellectual Property

• The App and its content are protected by copyright, trademark, and other intellectual property laws
• You may not copy, modify, distribute, or create derivative works from the App without our written permission
• Our trademarks, logos, and brand names are our property

Third-Party Services

The App may integrate with third-party services (Firebase, Apple App Store, etc.). Your use of these services is subject to their respective terms and privacy policies.

Termination

By You

• You may stop using the App at any time
• You may delete your account through the App settings

By Us

We may suspend or terminate your access to the App if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We discontinue the App or service

Upon termination, your right to use the App will immediately cease, and we may delete your account and data in accordance with our Privacy Policy.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of the App's features

We do not guarantee that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or other intangible losses
• Any damages resulting from your use or inability to use the App
• Any damages resulting from unauthorized access to or alteration of your data

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Providing notice through the App or email (where applicable)

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which you reside, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

• Good faith negotiation
• Binding arbitration (if applicable)
• Courts of competent jurisdiction

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

Acknowledgment

By using KINETIC FLOW AI, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
